Terms of Service

Welcome to Flaab. These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Viral Digital Dynamics SAS, a company incorporated under the laws of France ("Company," "we," "us," or "our"), governing your access to and use of theFlaab platform ("Flaab", "Service", or "Platform") available at https://flaab.app, including any associated mobile applications, APIs, and services.

If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" refers to that entity.

Flaab is a content management platform that provides the following core functionalities:

• Content Storage: Upload, organize, and store photos and videos on our platform.
• Content Publishing: Publish content from Flaab to your connected third-party social media accounts, including Instagram, TikTok, LinkedIn, and YouTube Shorts.
• Account Management: Connect and manage multiple social media accounts from a single dashboard.

Flaab acts as an intermediary tool to facilitate content publishing. We do not own, control, or operate any third-party social media platform. Your use of those platforms is subject to their respective terms of service and policies.

To use the Service, you must:

• Be at least 16 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher).
• Be at least 18 years of age if required by the terms of any third-party social media platform you connect to Flaab.
• Have the legal capacity to enter into a binding agreement.
• Not have been previously suspended or removed from the Service.
• Comply with all applicable local, national, and international laws and regulations.

By using the Service, you represent and warrant that you meet all eligibility requirements. If you do not meet these requirements, you must not use the Service.

4.1 Account Creation

To access the Service, you must create an account. Authentication is managed through our third-party authentication provider, Clerk. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate and complete.

4.2 Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to immediately notify us at support@flaab.app if you become aware of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Responsibility

You are responsible for all activities that occur under your account, whether or not authorized by you. You must not share your account credentials with any third party or allow any third party to access the Service through your account.

5.1 Authorization

To publish content through Flaab, you must connect one or more social media accounts (Instagram, TikTok, LinkedIn, and/or YouTube). By connecting a social media account, you authorize Flaab to access and interact with that account on your behalf, solely for the purpose of publishing content as directed by you.

5.2 Your Responsibilities

When connecting social media accounts and publishing content through Flaab, you acknowledge and agree that:

• You are the authorized owner or administrator of each connected social media account.
• You will comply with the terms of service, community guidelines, and all applicable policies of each connected platform at all times.
• You are solely responsible for all content published through Flaab to your social media accounts.
• Flaab does not review, moderate, or approve content before publication. Publishing content that violates a platform’s policies may result in penalties imposed by that platform, and Flaab bears no responsibility for such consequences.
• You will not use Flaab to engage in any activity that violates the rules or policies of any connected social media platform, including but not limited to spam, inauthentic behavior, harassment, or intellectual property infringement.

5.3 Third-Party Platform Terms

Your use of the Service in connection with third-party social media platforms is subject to the following platform terms, which you must review and accept independently:

• Instagram/Meta: Meta Platform Terms, Instagram Terms of Use, and Instagram Community Guidelines.
• TikTok: TikTok Terms of Service, TikTok Community Guidelines, and TikTok Developer Terms of Service.
• LinkedIn: LinkedIn User Agreement, LinkedIn Content Policy, and LinkedIn Data API Terms.
• YouTube: YouTube Terms of Service, YouTube Community Guidelines, and Google API Services Terms of Service.

In the event of a conflict between these Terms and any third-party platform’s terms, the more restrictive provision shall apply with respect to your use of that platform through Flaab.

5.4 Disconnection & 5.5 API Changes

You may disconnect any social media account from Flaab at any time through your account settings. Third-party social media platforms may modify, restrict, or discontinue their APIs at any time. We are not liable for any loss of functionality resulting from changes made by third-party platforms.

You retain all ownership rights in the content you upload ("User Content"). By uploading, you grant Flaab a specific license to facilitate the Service. You are solely responsible for ensuring your content does not violate laws or third-party rights. We reserve the right to remove content found in violation of these terms.

You agree not to use the Service to:

• • Violate applicable laws or third-party rights.
• • Upload illegal, harmful, or abusive content.
• • Upload content exploiting minors (CSAM).
• • Engage in spam or inauthentic engagement.
• • Impersonate any person or entity.
• • Manipulate engagement metrics artificially.
• • Upload viruses or malware.
• • Attempt unauthorized access to the Service.
• • Interfere with the Service's integrity.
• • Reverse-engineer the Service's code.
• • Scrape data in violation of terms.
• • Use automated bots without authorization.
• • Circumvent rate limits or security measures.
• • Resell the Service without consent.

Violation of these prohibitions may result in immediate suspension or termination of your account at our sole discretion.

Flaab’s IP: The Service and all related materials ("Flaab Materials") are owned by Viral Digital Dynamics SAS. You are granted a limited, revocable license to access the Service.

Feedback: Any feedback you provide grants us an unrestricted right to use it without compensation.

Third-Party IP: Flaab respects the IP rights of platforms like Instagram, TikTok, LinkedIn, and YouTube and is not affiliated with or endorsed by them.

If you believe User Content infringes your copyright, submit a DMCA notice to our agent at legal@flaab.app including the required details under applicable law.

Features may require a paid subscription. Fees are non-refundable generally. Subscriptions auto-renew unless canceled. We may modify pricing with 30 days’ notice. You may cancel anytime via account settings.

We may modify the Service or terminate your access for violations, platform requests, inactivity, or non-payment. You may terminate your account at any time at support@flaab.app.

You agree to indemnify Viral Digital Dynamics SAS against claims arising from your use of the Service, User Content, or violation of these Terms/laws.

Governing Law: Laws of France.
Resolution: Informal negotiation first. Exclusive jurisdiction in courts of Paris, France (subject to consumer protection laws).
